And then they were released on bail pending a May 1982 trial. On May 20, 1982, an arrest warrant was issued for Borup when she failed to appear for her trial. The warrant was based on a Queens County Indictment. It charged her with riot in the first degree and assault in the first degree.

In the Eastern District of New York, Donna Joan Borup was charged with unlawful flight to avoid prosecution. And on September 14, 1982, a federal arrest warrant was issued for her.
